Terms and conditions for WhiteConcierge service
1. Definitions
In these terms and conditions the words and phrases below have their meanings shown next to them:
we, us, our means WhiteConcierge of PO Box 36, Worldwide House, Thorpe Wood, Peterborough, PE3 6SB, England, whose registered office is at 65 Kingsway, London WC2B 6TD; its employees and agents; its successors and includes any business or other person to whom we may transfer our rights to under these terms and conditions.
you, your means the person who has requested the service.
Customer Communication Centre means any customer call centre operated by us.
personal information means any information given by you to us by any method and including the details of your credit or payment cards.
services means those services described on this webpage.
2. Services
We provide the services by telephone through our Customer Communications Centre except where otherwise stated. When you contact us we will take reasonable steps to confirm your membership and you agree to keep all verification procedures and codes personal to yourself. You authorise us to act on your instructions given by telephone provided that we have followed any verification procedures. If you know or have reason to suspect that someone else knows any of your codes or other personal identifiers, you must immediately tell us. We may refuse to act on any instruction if:
- we doubt the authenticity of it or it is not sufficiently clear, or
- we believe that doing so will put us in breach of any law, regulation, code or contractual obligation binding on us.
The individual services are free of any transaction cost unless these are specifically mentioned. To ensure the quality of our service to you, calls to us are recorded and randomly monitored.
3. Personal Information
You agree to us holding and processing by computer or otherwise any personal information which we will process in accordance with the principles laid down in the Data Protection Act 1998. Your personal information may be transferred outside of the European Union for the purposes of our fulfilling some of the services. We will endeavour to ensure that any third party data controller undertakes to treat the data as we would. We will not disclose any personal information to any third party except:
- if it is necessary for the provision of any individual service including any credit or payment card company used to pay for any service
- you have specifically agreed that we may
- for fraud prevention purposes
- to any person who may assume our rights under these terms and conditions
- if we have a right or duty to disclose or are compelled to do so by law.
4. Limiting our Liability
This is important and you should read this section carefully.
We will not be liable to you:
- if your instructions are not sufficiently clear
- we are unable to perform any of our obligations (including delay) to you due to failure of any of our data processing systems, hardware or telecommunications systems or because of anything outside of our reasonable control which we will include amongst other things war, terrorism, natural disaster, failure of the internet and industrial dispute
- for any failure on the part of any service provider to deliver or provide services which have been booked on your behalf by us or advised by us
- for any failure in you providing us with correct information when requesting a service
- for anything specifically excluded, including any disclaimers appearing in the service descriptions, or elsewhere in these terms and conditions
- for any indirect or consequential losses if we fail to act on your instructions for any reason unless we specifically agree to accept responsibility.
Nothing will limit our liability to you for death or personal injury arising out of our negligence or for fraudulent misrepresentation or misstatement.
Our service does not replace travel or medical insurance.
5. Complaints
In the unlikely event that you are dissatisfied with any aspect of the service please contact us by telephone on 01733 318914 or write to us at WhiteConcierge Customer Services of PO Box 36, Worldwide House, Thorpe Wood, Peterborough, PE3 6SB and we will try to resolve any problems in accordance with our complaints policy.
6. Membership
Your membership is valid whilst you are a Clydesdale Bank Gold MasterCard cardholder and covers you and your partner or spouse and children under the age of 16.
7. Law
The terms and conditions shall be read and interpreted in accordance wit the laws of England.
